1. Acceptance of Terms

By downloading, installing, or using Auralyze (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.

2. Eligibility

You must be at least 17 years of age to use the App. By using Auralyze, you represent and warrant that you meet this age requirement. The App is rated 17+ due to dating-related content.

3. Description of Service

Auralyze is an AI-powered dating intelligence platform that provides conversation analysis, message generation, profile analysis, date preparation, and practice conversation features. The App uses artificial intelligence (Google's Gemini AI) to generate suggestions and insights based on data you provide. All AI processing occurs on remote servers.

4. AI-Generated Content

All AI-generated suggestions, messages, analyses, gameplans, and advice are provided for entertainment and informational purposes only. You acknowledge that:

• AI-generated content may contain inaccuracies, biases, or inappropriate suggestions
• Auralyze does not guarantee any outcomes from using AI-generated content
• You are solely responsible for how you use any suggestions provided by the App
• AI-generated content should not be relied upon as professional relationship or psychological advice

5. User Conduct

You agree not to use Auralyze to:

• Harass, stalk, threaten, or intimidate any person
• Generate content that is illegal, harmful, defamatory, or abusive
• Impersonate another person or misrepresent your identity
• Manipulate, deceive, or exploit others in their dating interactions
• Circumvent any usage limits, rate limits, or security measures
• Reverse engineer, decompile, or attempt to extract the AI models, prompts, or proprietary algorithms
• Use the App in any manner that violates applicable laws or regulations

6. Subscriptions & Payments

Auralyze offers free and premium tiers. Premium subscriptions and consumable purchases are billed through Apple's App Store:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• Consumable in-app purchases (e.g., SOS Pack, Profile Roast Pack) are non-refundable once used.

Refunds are subject to Apple's refund policies. Cancellation of the current subscription is not allowed during the active subscription period.

7. Your Content

You retain ownership of all content you provide to the App (messages, screenshots, profile information). By using the App, you grant Auralyze a limited, non-exclusive license to process your content solely to provide the App's services to you. Content generated by the AI is provided to you for your personal use.

8. Account Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. You may delete your account at any time from the App's Settings.

9. Data & Privacy

Your use of Auralyze is also governed by our Privacy Policy. By using the App, you consent to the collection and use of data as described therein, including the server-side processing of your content by AI.

10. Disclaimer of Warranties

Auralyze is provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Auralyze and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages arising from the outcomes of social interactions influenced by AI suggestions, loss of data, or loss of profits. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Auralyze and its operators, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Apple EULA

This App is licensed, not sold, to you. Your use of the App is also subject to the terms of the Licensed Application End User License Agreement set forth by Apple, which is incorporated herein by reference.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, United Kingdom. Any disputes arising from these Terms or the App shall be resolved exclusively in the courts of England and Wales.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the “Last updated” date. Continued use of the App after changes constitutes acceptance of the updated Terms.
